Update on Sundiata’s Parole Appeal Hearing

The hearing for Sundiata Acoli’s parole argument happened Wednesday May 28th in New Jersey’s Appellate Court. It was in response to the New Jersey state parole board’s continued denial of Sundiata’s release after serving 40 years in prison and completing his sentence.

The hearing was open to the public. The panel of three judges will provide a decision in about three weeks. As soon as we hear anything, we will update folks. We ask everyone to keep Sundiata in their thoughts and prayers until then.

MI-CATS 3 Sentenced to 13 Months Probation

Following over a month inside the Ingham County Jail after a guilty verdict by a jury, the MICATS 3 were sentenced to 13 months probation by Circuit Judge William Collette

“Though my heart aches for moments I will miss, I regret nothing,” wrote Lisa Leggio from her cell in Ingham County Jail while awaiting sentencing.

This afternoon, Leggio, and her fellow MICATS members Barbara Carter and Vicci Hamlin were sentenced to 13 months probation and $45,000 in restitution to the police.  Over 100 supporters packed the tension filled courtroom where Judge William Collette of Ingham County presides.  Though the defendants were surrounded by the love of their families and friends throughout the trial and sentencing, we recognize that this is not the case for most people who are forced by circumstance to interact with the justice system.  The prison-industrial complex is a reality of life for so many folks who have been disenfranchised by the capitalist system from the start, and we hope that the sentencing of the MICATS 3 will only serve to highlight the struggles of those for whom community support and opportunities were never possibilities. The closing arguments in the NATO 3 trial concluded today and the jury began deliberations to determine whether each of them will be convicted or acquitted on each of the seven charges they are facing. The jury was released for the evening at about 11pm and are scheduled to return at 9am tomorrow to continue deliberations. They must keep deliberating until they reach a verdict.

Brent, Jared, and Brian looked focused and determined in court today, although they must have been stressed and exhausted beyond all belief. We will keep you updated on how they are doing as we hear more from them. Eco-Saboteur Rebecca Rubin Gets 5-Year Federal Prison Sentence

A federal judge on Monday sentenced eco-saboteur Rebecca Rubin to five years in prison — less than what prosecutors sought for the former fugitive from Canada.

Rubin, voice shaking, apologized to her family, the court, firefighters as well as targets of the Animal Liberation Front and Earth Liberation Front.

“I was so convinced at the righteousness of my beliefs, that I chose to ignore my own wrongdoing,” Rubin said.

Chief U.S. District Judge Ann Aiken, who presided over the sentencing hearings in 2007 of Rubin’s co-conspirators in Eugene, praised Rubin’s statement, calling it “the most thoughtful, well-stated, honest, unvarnished apology/explanation.”

“I understand more than you know when you work in a democracy that all things look like they’re black and white when you’re young,” the judge said. “And there are so many shades of gray.”

Federal prosecutors had asked Aiken for a 7 ½-year prison sentence for Rubin. Rubin’s attorney argued for five years.

rebecca rubinRubin pleaded guilty last October before Aiken to arson, attempted arson and conspiracy to commit arson in Oregon, Colorado and California as part of the underground Earth Liberation Front and Animal Liberation Front. She participated in four crimes, including planning the eventual $12 million fire that destroyed a ski resort under construction in Vail, Colo., in 1998. (more…)

Luke O’Donovan Update

Luke-is-the-fucking-greatest-300x300It has been over a year since Luke was arrested and charged with five felonies after being assaulted on New Year’s Eve. We apologize for the long delays between updates. Luke’s case has been moving very slowly. He has had only one minor court appearance since his release in January of 2013.

We write now to publicize Luke’s next court date, which will be a motions hearing set forThursday, January 30th at 10am. At court, Luke’s lawyers will argue for Luke to be granted a Self-Defense Immunity Hearing, where a case would be made for Luke having acted in self-defense. If a Self-Defense Immunity Hearing finds that Luke did indeed act in self-defense, Luke would be immune from prosecution under Georgia law.

So far we have raised over $9,000 to cover Luke’s lawyer fees, bond, and other court and jail costs. There have been fundraisers across the country, and for this we are grateful. Unfortunately, we still need $4,000 to cover the rest of Luke’s legal fees from now through any potential trial. Any and all donations will be appreciated. Jeremy Hammond Sentenced To 10 Years In Prison

NEW YORK — Convicted hacker Jeremy Hammond was sentenced Friday to 10 years in prison for stealing internal emails from the global intelligence firm Stratfor.

During the hearing, he claimed in a defiant sentencing statement that his acts were meant to expose the truth and that he hacked foreign government websites at the behest of an FBI informant.

“The acts of civil disobedience and direct action that I am being sentenced for today are in line with the principles of community and equality that have guided my life,” Hammond said in a prepared statement provided to HuffPost Live. “I took responsibility for my actions, by pleading guilty, but when will the government be made to answer for its crimes?” (more…)

Rebecca Rubin Will Be Sentenced to Between 5 and 7.5 Years on January 27th, 2014

A federal judge in Portland found eco-saboteur Rebecca Rubin guilty on Thursday of taking roles in a series of environmentally motivated firebombings and vandalism in Oregon, Colorado and California between 1998 and 2001.

Rubin, 40, a Canadian citizen who fled north of the U.S. border to live underground, tried to surrender to U.S. authorities in 2009, said her lawyer, Richard J. Troberman of Seattle. But there were holdups between Rubin’s lawyers and U.S. government prosecutors.

Prosecutors in California were adamant that Rubin must serve at least 30 years in prison unless she agreed to give up the names of her co-conspirators and offer other assistance to the government. But she steadfastly refused to turn over the names of any of her crime partners. (more…)

King Peaceful sentenced to 15 years

Russell “King Peaceful” Kilfoil was sentenced to 15 years today in the Middle District of North Carolina.  The Judge shaved off some years from the US Attorney’s maximum recommendation.  Kilfoil received less than the recommended time due to his own efforts and life experiences.  Though the Feds were able to place Kilfoil in a leadership role of the NC ALKQN, for the purpose of gaining a stiffer conviction, and to further demonize Kilfoil and the NC ALKQN, on the actions of others, we hope that Kilfoil feels that even though 15 years is a long time the feds did not take his life.

Rebecca Rubin Plea Hearing October 10th

Green Scare defendant Rebecca Rubin is scheduled for a Change of Plea Hearing for 10/10/2013 at 10:00AM in Portland Federal Courtroom 12A before Chief Judge Ann L. Aiken.    Rebecca is alleged to have been a member of a group of environmental and animal rights activists accused of eco sabotage, and specifically, she has been accused of being involved in actions against BLM wild horse capture facilities that brutally rounded up wild mustangs from public lands and sold them for slaughter, an arson at the Vail Ski Resort in Vail, CO, and an action at US Forest Industries in Medford, OR.  Her last alleged action took place in 2001.   A Canadian citizen, Rubin voluntarily turned herself into federal authorities in January of 2013, 8 years after her alleged codefendants were apprehended and prosecuted.  She is believed to be entering into a non-cooperation plea agreement, though the exact terms of that agreement are not publicly available at this time.

The federal government allege that this cell of ELF and ALF activists were responsible for over 20 actions, including arsons, between 1996 to 2001 and caused over $40 million in damages.

Letters urgently needed for Jeremy Hammond

Jeremy Hammond, who is being held right here in NYC, has an upcoming sentencing date. In preparation for that, his support crew is urging folks to write letters requesting leniency from the judge. NYC ABC, in turn, are asking you to help Jeremy and his supporters. Historically, pre-sentencing letters have proven to persuade judges’ opinions in that they show how much support someone has and how valuable they are to their communities. Jeremy deserves to be free NOW, so whatever you can do to encourage Judge Preska to do the right thing, please do it. And don’t forget to pack the courtroom on Friday, November 15th, the day on which Jeremy will be sentenced.
